1.1 These terms and conditions apply to prize competitions operated by LHC Group under the name Leica Hunter Competitions (the Promoter,
we, us or our) through www.leicahuntercompetitions.com (the Website).
1.2 Please read these terms carefully before entering a Competition. By submitting an Entry, you confirm that you have read, understood and agreed to be bound by these terms, the information on the relevant Competition page and any related promotional material.
1.3 Each Competition is a separate prize competition and will have its own prize, opening date, closing date, total number of available Entries and any additional requirements displayed on the relevant Competition page.
1.4 Any Competition-specific term will apply only if it is clearly and prominently presented to the Entrant before entry. Nothing on a Competition page may override these terms in a way that is unlawful or materially unfair to Entrants.
2.1 Competitions are open to persons aged 18 or over who are resident in the United Kingdom, the Republic of Ireland, North America, Central America, South America, Europe, Asia or Oceania, except where participation is prohibited by local law.
2.2 Employees of the Promoter and any person directly involved in administering a Competition may not enter that Competition.
2.3 You are responsible for ensuring that entering a Competition is lawful in the country or territory where you live. We accept no responsibility where an Entrant participates unlawfully. If you are uncertain, you should obtain independent legal advice before entering.
2.4 We may refuse an Entry, suspend or close an account, or disqualify an Entrant where we reasonably believe that the Entrant:
2.5 We may ask an Entrant to provide reasonable evidence of age, identity, residence, eligibility and authority to use the payment method used. We will not disqualify an Entrant or withhold a prize except on grounds stated clearly in these terms or on the relevant Competition page.
3.1 To enter a Competition through the Website, you must create an account and provide accurate, complete and current contact information, including your email address, postal address and telephone number.
3.2 Follow the on-screen instructions to:
3.3 Every Competition requires Entrants to exercise skill, knowledge or judgment. The question or challenge will be designed so that it is reasonably likely either to discourage a significant proportion of people from entering or to prevent a significant proportion of Entrants from qualifying for the draw. A Competition will not be conducted as a simple game of chance.
3.4 Only Entries that answer the question or complete the challenge correctly will qualify for the draw. An Entry is not complete until the question or challenge has been completed successfully, payment has cleared and we have sent confirmation that the Entry has been accepted.
3.5 We accept no responsibility for Entries that are incomplete, delayed, lost, corrupted or not received because of circumstances outside our reasonable control.
3.6 There is no per-person limit on the number of Entries an Entrant may purchase, subject to the number of Entries remaining available in the relevant Competition. The total number of Entries available will be displayed on the Competition page.
3.7 Entries submitted after a Competition has closed will not be accepted. If payment is taken in error after closing, it will be refunded to the original payment method.
3.8 An Entry may be cancelled if its payment is charged back, reversed or otherwise not received by us.
4.1 Each Competition will run for the period shown on its Competition page (the Promotion Period).
4.2 A Competition will close when its displayed closing timer expires or when all available Entries have been sold, whichever happens first.
4.3 Closing dates will not be changed merely because fewer Entries than expected have been sold. We will change a closing date only where circumstances outside our reasonable control make it unavoidable, or where the change is necessary not to disadvantage Entrants. Any change will be communicated promptly and prominently, and we will take reasonable steps to ensure that it does not unfairly disadvantage anyone who has entered or intended to enter.
4.4 We may use images and details of a prize in promotional material while the Competition is open.
4.5 We may suspend, close or cancel a Competition only where reasonably necessary because of circumstances outside our reasonable control, legal or regulatory requirements, fraud, technical failure or another circumstance that makes fair administration impossible. If a Competition is closed early but can still be administered fairly, the Winner will be drawn from all valid and eligible Entries received before closure. If a Competition is cancelled without a draw, affected Entrants will receive a monetary refund to the original payment method unless they expressly choose account credit.
5.1 Promptly after a Competition closes, the Winner will be selected at random from all valid and eligible Entries using the independent online random-number generator provided by RandomDraws.com.
5.2 The draw may be livestreamed on Instagram, Facebook or another channel announced by us. The range entered into the random-number generator will correspond to the valid Entry numbers for that Competition.
5.3 Unless the Competition page states that runner-up prizes are available, there will be one first-prize Winner per Competition.
5.4 Our decision regarding the administration of a Competition and the result of a draw is final, subject to applicable law.
5.5 If a prize is awarded incorrectly because of a technical or human error, we may withdraw or recover that prize and award it to the correct Entrant. We will act reasonably and without limiting any rights an affected person may have under applicable law.
5.6 We will retain appropriate records of the draw so that the selection process can be demonstrated if reasonably required by the Advertising Standards Authority or another competent authority.
6.1 We will attempt to contact the Winner using the telephone number and email address associated with their account, normally within 12 hours of the draw. Entrants are responsible for keeping their contact details accurate and up to date and for checking their email, including spam or junk folders.
6.2 Before a prize is released, the Winner must provide satisfactory proof of identity, age and eligibility. We may also request evidence that the Winner was authorised to use the payment method used for the winning Entry.
6.3 We will make reasonable efforts to contact the Winner. The Winner must respond, accept the prize and provide the information reasonably requested by us within 28 days of our first notification. If the Winner cannot be contacted despite reasonable efforts, does not respond within that period, fails verification or is disqualified on grounds stated in these terms, the Winner will forfeit the prize and we may draw an alternative Winner using the same method.
6.4 After verification, the Winner must cooperate with us to arrange collection or delivery. We will award and, where applicable, deliver the prize within 30 days after the Winner accepts it, unless the Competition page clearly states a longer delivery period or circumstances outside our reasonable control make that impossible. If delayed, we will keep the Winner informed and arrange delivery as soon as reasonably possible.
6.5 To demonstrate that a valid award took place, we will publish or make available the Winner’s surname and county, or other information permitted by the CAP Code, unless the Winner objects or asks us to reduce the information published. We may still provide the information and winning Entry to the Advertising Standards Authority if required to do so.
7.1 The prize for each Competition will be described on the relevant Competition page. Prizes are selected and acquired by the Promoter and remain our property until they are transferred to the Winner.
7.2 Unless stated otherwise on the Competition page, prizes must be collected by the Winner. Where we agree to arrange delivery, the timing and method of delivery will be agreed with the Winner.
7.3 A prize must be accepted as awarded and is non-transferable and non-exchangeable. No cash alternative will be available unless it is clearly stated on the Competition page before entry.
7.4 We may substitute a prize only where circumstances outside our reasonable control make this necessary. Any substitute will be a reasonable equivalent of equal or greater value. We will not reduce or withhold a prize merely because fewer Entries than expected were sold.
7.5 Prizes are supplied as described and, to the fullest extent permitted by law, without any additional warranty from us. Nothing in these terms affects any warranty or statutory right that cannot lawfully be excluded.
7.6 Risk in a prize passes to the Winner upon collection or completed delivery. The Winner is responsible for arranging any insurance required after that point.
7.7 A Winner outside the United Kingdom is responsible for any tax, duty, customs charge or other cost arising from receiving or using the prize, unless stated otherwise on the Competition page.
8.1 We may invite a Winner to take part in reasonable publicity, including photographs or video connected with the Competition and prize handover. Participation is voluntary and is not a condition of receiving a prize unless a specific, lawful publicity requirement was prominently disclosed before entry.
8.2 We will obtain any consent required by applicable law before using a Winner’s image, likeness, social-media handle or other personal data for marketing that is not necessary to administer the Competition or announce its result.
8.3 Where consent is the lawful basis for such use, the Winner may refuse or withdraw that consent at any time by contacting us. Withdrawal will not affect any use that was lawful before consent was withdrawn.
9.1 Except where these terms state otherwise or the law requires it, Competition Entries are final once accepted and Entry fees are non-refundable. Nothing in these terms limits any cancellation, refund or other consumer right that applies by law.
9.2 We may, at our discretion and subject to applicable law, issue a refund or account credit where a Competition is cancelled, where an Entry was accepted because of a technical error after the Competition closed, or in other exceptional circumstances.
9.3 Where a refund is made, it will normally be returned to the payment method used for the Entry. Processing times may depend on the relevant payment provider.
10.1 Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
10.2 Subject to clause 10.1, we are not responsible for loss or damage that:
10.3 We do not exclude or limit any statutory rights or remedies available to a consumer that cannot lawfully be excluded or limited.
10.4 Entrants are responsible for reasonably foreseeable loss we suffer as a result of their fraud, misuse of the Website or material breach of these terms, subject to our duty to mitigate our loss.
11.1 We do not guarantee that the Website or any related system will always be available, uninterrupted, secure or error-free. We may suspend access for maintenance, security, improvement or other operational reasons.
11.2 We are not responsible for failed, incomplete or corrupted transmissions or for failures involving devices, networks, internet connections, software, payment services or other third-party systems outside our reasonable control.
11.3 Only Entries recorded as valid in our systems will be included in a draw. A display or calculation error on a device or webpage does not by itself create a valid Entry.
11.4 You must not interfere with the Website, attempt to gain unauthorised access, introduce malicious code, use automated means to enter a Competition, or otherwise disrupt the Website or another person’s use of it.
12.1 We will process personal data for the purposes of administering Competitions, verifying Entrants and Winners, processing payments, preventing fraud, delivering prizes and complying with legal obligations.
12.2 We may share personal data where reasonably necessary with payment providers, prize suppliers, delivery partners, professional advisers, regulators, law-enforcement bodies, prospective purchasers of our business and other service providers acting on our behalf.
12.3 Where personal data is transferred outside the United Kingdom, we will use safeguards required by applicable data-protection law.
12.4 Further information about how we use personal data, the legal bases we rely on and the rights available to individuals should be set out in our Privacy Policy on the Website.
12.5 Entry into a Competition is not conditional on agreeing to receive marketing. Email or text marketing will be sent only where permitted by the Privacy and Electronic Communications Regulations 2003 and applicable data-protection law. Any request for consent will be separate, specific and optional, and each marketing message will provide a simple way to opt out.
12.6 We will provide an accessible method for making data-protection complaints, acknowledge such complaints within 30 days and respond without undue delay, in accordance with applicable law.
13.1 We may amend these terms for future Competitions by publishing an updated version on the Website. The terms in force when an Entry is accepted will apply to that Entry unless a change is required by law or is necessary to administer the Competition fairly and does not materially disadvantage the Entrant.
13.2 All advertising and Competition pages will state or clearly link to the significant conditions that may affect a person’s decision to enter, including how to participate, the closing date, eligibility and geographical restrictions, the total number of Entries available, the nature and number of prizes, any costs, the Winner-selection method and any unusual prize-collection or delivery conditions.
13.3 We may send notices to the most recent email address supplied by an Entrant. Entrants must keep their account information current.
13.4 If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.
13.5 A delay or failure to enforce a right does not waive that right.
13.6 A person who is not a party to these terms has no right to enforce them under the Contracts (Rights of Third Parties) Act 1999.
13.7 These terms and each Competition are governed by English law. The courts of England and Wales will have jurisdiction, except that a consumer resident elsewhere may also have the benefit of any mandatory rights and may be entitled to bring proceedings in the courts of their home jurisdiction.
14.1 Questions or complaints about a Competition should be sent using the contact details published on the Website. Please include your name, account email address, Competition name and Entry or order number where available.
14.2 We will aim to acknowledge and investigate complaints within a reasonable period.
